OVERVIEW

U.S. TAX FOR KOREAN EXPATRIATES

Working in the United States as an expatriate can create tax and reporting obligations in both the U.S. and Korea. U.S. tax residency, compensation paid by a Korean headquarters, housing and other expatriate benefits, Korean investment income, foreign financial accounts, and social security coverage can all affect the U.S. tax return. Dow & Sohn CPAs helps Korean expatriates understand these requirements and coordinate their U.S. tax filings with their Korean income and financial information.

FAQ

1. Does a Korean expatriate working in the U.S. have to file a U.S. tax return?

It depends on U.S. tax residency, income, and other circumstances. Korean employees working in the U.S. may have federal and state filing obligations even when some or all of their compensation is paid by a Korean employer.

2. When does a Korean expatriate become a U.S. tax resident?

U.S. tax residency is generally determined under rules including the Substantial Presence Test, although exceptions and tax treaty provisions may apply depending on the circumstances.

3. Do I have to report salary paid by my Korean headquarters?

Potentially. U.S. tax treatment depends on factors including tax residency and where the services are performed. The fact that compensation is paid from Korea does not by itself determine whether it is taxable in the United States.

4. Can Korean taxes be credited against U.S. taxes?

Depending on the type of income and taxes paid, a Foreign Tax Credit may be available to reduce double taxation. The applicable rules should be reviewed for each type of income.

5. Do Korean expatriates have to file FBAR?

U.S. persons may be required to file an FBAR when the aggregate maximum value of their foreign financial accounts exceeds the applicable reporting threshold. Korean bank and securities accounts may therefore need to be included.

6. Are Korean expatriates exempt from U.S. Social Security and Medicare tax?

Not automatically. Under the U.S.–Korea Social Security Agreement, certain employees temporarily assigned from Korea to the United States may remain covered by the Korean system if the applicable requirements are satisfied. A Certificate of Coverage may be required to document the applicable coverage.

7. What happens when an expatriate returns to Korea?

The year of departure may require special consideration of U.S. tax residency, the timing and source of income, state residency, and continuing U.S. reporting obligations.

8. Can Dow & Sohn CPAs handle both expatriate tax returns and the company's U.S. tax matters?
